This is a skill-based contest. Entries are not selected at random. No element of the winner selection is determined by chance.
Stage 1, Judges’ Shortlist (July 11 through July 14, 2026). A panel of judges selected by the Sponsor will review every eligible entry posted during the Contest Period and will select ten (10) finalists (the “Top 10”) based on the following criteria: creativity and originality (40 percent); visual quality and composition (30 percent); and overall representation of the SaveMaxAuto brand spirit (30 percent).
Stage 2, Finalist Showcase (July 15 through July 20, 2026). Each of the Top 10 finalist photographs will be republished as a curated showcase on the official @SaveMaxAuto Instagram account between July 15 and July 20, 2026. The finalist showcase is for marketing purposes only. No public votes, likes, comments, story poll responses, shares, saves, or any other public engagement metric will be counted or considered in selecting the Top 3 or the Grand Prize winner. The finalist showcase does not affect, and is not part of, the judging process.
Stage 3, Top 3 and Grand Prize Selection (on or around July 21 through July 24, 2026). The same Sponsor-selected judges’ panel will reconvene and, applying the same criteria — creativity and originality (40 percent), visual quality and composition (30 percent), and brand spirit (30 percent) — will narrow the Top 10 to three (3) finalists (the “Top 3”) and then select one (1) Grand Prize winner from the Top 3.
The judges’ decisions are final and binding. Whether any entry is selected depends on the judges’ evaluation of that entry relative to the other entries received. In the event of a tie at any stage, the panel will conduct a skill-based runoff among the tied entries on the same criteria, and the result of that runoff is final.
This Contest is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc.
One (1) Grand Prize will be awarded: a cash prize of Five Thousand U.S. Dollars ($5,000), paid directly to the winner. The prize may be used for any purpose at the winner’s sole discretion. The prize is non-transferable and may not be substituted by the winner, except that the Sponsor may substitute a prize of equal or greater value if the stated prize becomes unavailable. The Approximate Retail Value of the Grand Prize is $5,000.00. Only one (1) prize will be awarded.
The winner is solely responsible for all federal, state, and local taxes and any other costs associated with acceptance or use of the prize. The Sponsor will issue an IRS Form 1099 to the winner where required by law. The Sponsor will arrange payment with the verified winner within thirty (30) days after the Sponsor’s receipt of all required verification documents.
The winner will be notified by Instagram direct message from the official @SaveMaxAuto account on or around July 24, 2026. Any contact information needed to confirm identity, verify eligibility, and deliver the prize will be collected directly from the winner through that direct-message conversation or through a secure channel designated by the Sponsor within that conversation. The winner must respond within seventy-two (72) hours of the first notification attempt to claim the prize. If the winner does not respond within seventy-two (72) hours, the prize may be forfeited and an alternate winner may be selected by the judges’ panel from the remaining Top 3 finalists.
Anti-Phishing Notice. The Sponsor will contact entrants only from the verified @SaveMaxAuto Instagram account. The Sponsor will never ask an entrant or winner to pay a fee, make a purchase, or provide credit card numbers, banking credentials, or account passwords in order to enter, win, or claim the prize. Any message that requests payment or login credentials, or that originates from any other account, is fraudulent and should be reported to the Sponsor and to Instagram.
The winner may be required to provide identifying information — such as a government-issued photo ID and proof of Texas residency — and to complete and return an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release, within seven (7) days of notification. Failure to return required documents within the specified time, or the inability to verify eligibility, may result in forfeiture of the prize and selection of an alternate winner.
Except where prohibited by law, by accepting the prize the winner consents to the Sponsor’s use of the winner’s name, city and state of residence, likeness, photograph (including the winning entry), voice, and statements for advertising, promotional, and publicity purposes, in any and all media now known or later developed, worldwide, without further notice, compensation, review, or approval.
Entries must not contain material that is obscene, offensive, defamatory, threatening, harassing, discriminatory, or otherwise objectionable, as determined by the Sponsor in its sole discretion. Entries must not infringe the intellectual property, privacy, or publicity rights of any third party. Entries that violate these standards will be disqualified.
The Sponsor reserves the right to cancel, suspend, or modify the Contest, in whole or in part, if fraud, technical failure, or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right to disqualify any entrant who tampers with the entry process, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner.
By entering, each entrant agrees to release, discharge, and hold harmless the Sponsor and its affiliates, subsidiaries, officers, directors, members, managers, employees, agents, and representatives from any and all claims, damages, losses, costs, or expenses arising out of participation in the Contest or acceptance, use, or misuse of the prize, including personal injury, death, or property damage. The Sponsor is not responsible for lost, late, incomplete, misdirected, stolen, or illegible entries, or for any technical malfunction, failure, or difficulty of any kind.
Personal information collected from entrants will be used solely to administer the Contest and as otherwise described in the Sponsor’s Privacy Policy. The Sponsor will not sell entrant information to third parties.
Except where prohibited, all disputes arising out of or relating to this Contest shall be governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any legal proceeding shall be brought exclusively in the state or federal courts located in Harris County, Texas, and each entrant consents to the personal jurisdiction and venue of those courts.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT, TO HAVE A JURY TRIAL, AND TO PARTICIPATE IN A CLASS ACTION.
(a) Agreement to Arbitrate. This Section governs all disputes, claims, and controversies arising out of or relating to the Contest, the prize, or these Official Rules, including their existence, breach, interpretation, validity, or termination (each, a “Dispute”), except as expressly provided in subsection (e). Notwithstanding the Governing Law and Venue section above, and to the fullest extent permitted by law, each entrant and the Sponsor agree that every Dispute shall be resolved exclusively by final and binding individual arbitration, and not in court.
(b) Federal Arbitration Act. This Section evidences a transaction involving interstate commerce, and the Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this Section.
(c) Informal Resolution First. Before commencing arbitration, the party raising a Dispute must first send a written notice describing the Dispute and the relief sought to the other party, with notice to the Sponsor sent to the address in Section 1. The parties will attempt in good faith to resolve the Dispute for sixty (60) days after the notice is received. If the Dispute is not resolved within that period, either party may commence arbitration.
(d) Arbitration Procedure. The arbitration will be administered by the American Arbitration Association (the “AAA”) under its Consumer Arbitration Rules then in effect, as modified by these Official Rules, and will be conducted by a single neutral arbitrator. Where the amount in controversy does not exceed $25,000, the arbitration may be conducted, at the entrant’s election, by telephone, by videoconference, or based solely on written submissions. Any in-person hearing will take place in Harris County, Texas, unless the parties agree otherwise or the arbitrator determines that a different location is necessary to avoid undue burden on the entrant. The arbitrator’s award is final and binding, and judgment on the award may be entered in any court of competent jurisdiction, including the courts identified in the Governing Law and Venue section.
(e) Exceptions. Nothing in this Section requires arbitration of: (i) a claim that qualifies for, and is brought in, a small claims court with jurisdiction; or (ii) a request by either party for temporary, preliminary, or permanent injunctive or other equitable relief, including relief to protect intellectual property rights or to address unauthorized use of contest materials, which may be brought in the courts identified in the Governing Law and Venue section.
(f) CLASS ACTION WAIVER. ALL DISPUTES MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY’S INDIVIDUAL CLAIM.
(g) Severability of this Section. If the Class Action Waiver in subsection (f) is found unenforceable as to any Dispute, then that Dispute, and only that Dispute, shall be severed and brought in the courts identified in the Governing Law and Venue section, and the remainder of this Section shall continue to apply. If any other provision of this Section is found unenforceable, it shall be severed and the remainder of this Section shall remain in effect.
(h) Right to Opt Out. An entrant may opt out of this Section by sending written notice to the Sponsor at the address in Section 1 within thirty (30) days after the entrant’s first entry. The notice must include the entrant’s name, mailing address, Instagram handle, and a clear statement that the entrant wishes to opt out of arbitration. An entrant who timely opts out will not be bound by this Section, and the Governing Law and Venue section will govern any Dispute. Opting out has no effect on the entrant’s eligibility or participation in the Contest.
(i) Jury Trial Waiver. To the fullest extent permitted by law, each entrant and the Sponsor waive any right to a trial by jury in any Dispute.
If any provision of these Official Rules is held invalid or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
The Grand Prize winner’s first name, last initial, and city of residence will be publicly posted on the official @SaveMaxAuto Instagram account within seven (7) days of selection. For a written winner list, send a self-addressed, stamped envelope to: SaveMaxAuto LLC, Attn: Spot Max Photo Contest, 732 South 6th Street, Suite R, Las Vegas, NV 89101, within sixty (60) days after the winner announcement.
